About Us Yawoorroong Miriuwung Gajerrong Yirrgeb Noong Dawang Aboriginal Corporation (MG Corporation) was established in 2006 to receive and manage the benefits transferred under the OFA to the MG People, who are recognised under Australian law as holding Native Title over large areas in the North of Western Australia’s east Kimberley region. About the Role The Land and Heritage Manager (LAHM) will manage the NATIVE TITLE CAPACITY BUILDING PROGRAM Agreement to build capacity of MG Corporation in Land and Heritage Management. This project will enable MG Corporation to engage with third parties including but not limited to proponents and other relevant stakeholders, Government and statutory processes in relation to the operations of the business. This role will work closely with the Executive Chair and MG Traditional Owners to work within MG’s vision and a culturally safe environment. This includes: Lead, build and maintain positive strategic working relationships with all levels of State Government including high level negotiations. Lead funding negotiations to secure new programs and enhance existing programs. Employing and managing staff as Heritage Officers to perform tasks including coordinating, participating and assisting in Heritage surveys, providing Heritage advice, engaging with Aboriginal consultants, knowledge holders and leaders and engaging expert heritage service providers. Employing and managing staff to provide administration support. Training and upskilling of existing staff in areas of record keeping, negotiation and agreement making, legislative compliance and administrative functions; Develop information technology capabilities such as heritage record databases, ArcGIS or other relevant systems; Engaging dedicated resources to manage Aboriginal Heritage matters; Developing frameworks and guides related to the identification, protection and management of Aboriginal Heritage and the interaction with third parties. Duties and responsibilities include, but are not limited to: MANAGEMENT TEAM AND ORGANISATIONAL GOVERNANCE General compliance related to the Native Title Act 1993 (Cth), Corporations (Aboriginal and Torres Strait Islander) Act 2006 (Cth) (CATSI Act), Australian Charities and Not-for-profits Commission Act 2012 (Cth), Native Title (Prescribed Bodies Corporate) Regulations 1999 (Cth) and MG Corp’s Constitution. Reporting to GM and Executive Chair. PROJECT AND AGREEMENT IMPLEMENTATION AND COMPLIANCE Managing compliance of NATIVE TITLE CAPACITY BUILDING PROGRAM Agreement Lead, build and maintain positive strategic working relationships with all levels of State Government including high level negotiations. Lead funding negotiations to secure new programs and enhance existing programs. Manage Working Groups appointed under the agreement Organise and implement various implementation working groups Liaise and appoint external consultants where necessary Act on actions from key meetings; Complete funding and budget requirements and all reporting required for the agreement. ADMINISTRATIVE AND MEETING TASKS Organise and manage key meetings with State Government, agreement partners and other significant stakeholders; Maintain electronic and manual files and keeping records up to date, secure and accessible, as appropriate; Adhere to compliance procedures; Attend Board and other key meetings as required Periodic travel to Perth to attend meetings as required. HERITAGE MANAGERIAL Establish, Lead, and manage Heritage business unit. Develop annual budget and business plan for the Heritage business unit Coordinate all MG Corp. heritage related work. Day-to-day management of Heritage Management activities. Manage Heritage Unit staff enquiries, hiring, inductions, issues, complaints, and disciplinary actions. Develop and grow programs and services that meet core business outcomes Oversee and approve all financial and human resourcing responsibilities Support the GM and Executive Chair in heritage access negotiations. Report regularly to the Board on Heritage Compliance. HERITAGE OPERATIONAL LEADERSHIP Building a cohesive staff structure including structuring the Heritage team in a way that will collectively drive the organisation forward in a culturally safe environment. Ensure sound project planning and timely delivery of all heritage projects including: Develop and issue scopes of work for heritage field surveys including GiS data Manage the process for selecting heritage consultants Oversee logistic planning for heritage field work Lead and support staff run Heritage Manage Heritage reporting Ensure safe working practices are followed for all heritage field activities. Work with consultant/s to collect and register cultural heritage data for integration with mapping and record keeping systems. Provide advice to Senior Management regarding s18 or s16 matters with companies and Government agencies as required. Co-ordinate timely responses to activity notices with Compliance Unit HERITAGE PLANNING & POLICY Support the development of a Heritage Information Management Systems (ARCGiS) Working with MG Corp. communities to repatriate Ancestors and cultural materials including Heritage data. Develop a cultural Business records management system that allows tracking of all correspondence and documentation related to Heritage matters. Develop heritage incident investigation procedures and processes Develop Heritage Survey Standard Operating Procedures Review all systems, policy and procedures annually for compliance Regular travel on-country INTERNAL & EXTERNAL COMMUNICATIONS Strategic leadership and management of government relations and negotiations. Prepare and present reports, briefings and submissions to the Board and on heritage related functions. Strategic advice and guidance to the Executive Management Team on Native Title and Cultural matters. As required, attend governance and compliance meetings and committees, including General Meetings, Annual General Meetings, Cultural meetings and other key strategic committees and meetings. Other duties as directed by the GM and Executive Chair. Selection Criteria Essential: Experience working in the Native Title Sector, such as a RNTBC or Representative Body, or in a related role within a mining company, government sector, in-house counsel or legal practice. Knowledge of the Native Title Act 1993 (Cth), Corporations (Aboriginal and Torres Strait Islander) Act 2006 (Cth) (CATSI Act), Australian Charities and Not-for-profits Commission Act 2012 (Cth), Native Title (Prescribed Bodies Corporate) Regulations 1999 (Cth), the Mining Act 1978 (WA), the Future Acts regime, Native Title Agreements and other relevant legislation. Demonstrated strategic negotiation skills at a high level with government and other stakeholders to secure funding for new programs and services. Demonstrated experience in the management, organisation and conduct of heritage surveys under the Aboriginal Heritage Act (1972), and the process and procedural requirements of the Department of Planning, Lands and Heritage (DPLH); Demonstrated understanding and experience in the philosophical and practical issues of heritage conservation and its application to Aboriginal sites; Experience with Implementation of major agreements Experience in the area of Corporate Governance and government agreement compliance Excellent analytical skills, with the ability to work with a range of stakeholders to achieve outcomes; Demonstrated ability to exercise high level judgement and discretion, and to manage corporate compliance, contractual and legal issues in a not for profit / for purpose environment; Exceptional organisational skills and focus, including a capacity to prioritise tasks effectively and efficiently and manage time in accordance with strict deadlines, with meticulous attention to detail; Ability to manage competing demands Cultural competence, particularly with Aboriginal people; Proficient with Microsoft Office and Adobe Suite Experience managing Aboriginal land and cultural heritage and leading a team of Heritage officers to conduct heritage surveys. Experience working with specialist consultants such as Anthropologists, Palaeontologists and Archaeologists and an understanding of their role.
