Full-Time or Part-Time Permanent About the RSPCA NSW The Royal Society for the Prevention of Cruelty to Animals New South Wales (RSPCA NSW) is a not-for-profit animal welfare organisation that protects and cares for animals across NSW. As an integral part of its activities, RSPCA NSW has performed a statutory role in enforcing animal cruelty legislation in NSW since 1928. The organisation’s law enforcement and prosecution functions work together with its education, advocacy and support efforts, empowering communities to value the humane treatment of animals. About the Role The Information & Privacy Officer position has been developed to support the RSPCA NSW legal practice. Its primary purpose is to ensure and enhance organisational compliance with applicable information access and privacy laws. The Information & Privacy Officer is responsible for processing and deciding a variety of information access requests in accordance with the law, including applications under the Government Information (Public Access) Act 2009 (NSW) (GIPA Act) and in response to subpoenas and other orders to produce documents. The role also responds to and provides legal advice on privacy matters, including requests, complaints and notifications pursuant to the Privacy Act 1988 (Cth). This position has been designed flexibly and can be filled on a part-time or full-time employment basis. Candidates available to work 3, 4 or 5 days per week are encouraged to apply. Key accountabilities include but are not limited to: • Process and decide access applications and informal requests for the release of information in accordance with the GIPA Act and associated regulations, guidelines, policies and procedures. • Process and respond to subpoenas, summonses, statutory notices and other orders requiring the production of documents, including the preparation and filing of notices of objection. • As appropriate to the officer’s qualifications and experience, appear on behalf of RSPCA NSW in court proceedings to argue subpoena objections and related applications. • Respond to privacy complaints and requests to access or amend personal information in accordance with the Privacy Act 1988 and associated regulations, guidelines, policies and procedures. • Provide advice and support in relation to reported data breaches in accordance with applicable legislation, policies and procedures, including the Privacy Act 1988 and its Notifiable Data Breaches scheme. • Contribute to the development and improvement of internal practices, systems and precedent documents related to information access and privacy. • Develop and deliver training to staff in relation to information access and privacy obligations. Requirements • Tertiary qualifications in law. • Current NSW legal practising certificate or eligibility to hold one. • Unrestricted drivers’ licence. • Experience in applying and making decisions under information access legislation including the GIPA Act. • Experience in privacy law and compliance including under the Privacy Act 1988 (Cth). • Experience within regulatory or law enforcement agencies desirable.
