Description and Requirements Seeking Trademark and Anti-Counterfeiting Counsel to clear, protect, and enforce trademark/brand rights in the complex Chinese legal and business environment. Job Responsibilities: Manage and maintain China trademark portfolio, including conducting trademark clearance searches and filing and prosecuting trademark registration applications with the China National Intellectual Property Administration (CNIPA). Oversee trademark oppositions, invalidations, and other administrative proceedings with the CNIPA. Counsel China business teams on trademark licensing matters, including drafting trademark license agreements, trademark authorizations and related documentation. Work closely with cross-functional teams, including marketing, product development, and sales, to provide legal advice and ensure IP compliance. Work with internal business teams to verify counterfeit products and gather evidence to support complaints and/or conduct raids for the seizure or destruction of counterfeit goods from factories and markets. Enforce against online infringement activities by leveraging platform resources and digital tools to conduct takedowns on platforms like Alibaba, Taobao, and other social media sites, including handling unauthorized seller activity and parallel imports. Work with Sr. Global Brand Enforcement Manager and China Customs to record IP rights and provide training to border agents to help identify and intercept counterfeit goods. Job Qualifications: Law degree and admission to the bar in China. At least 8 years’ experience in intellectual property law, specifically focusing on trademark prosecution, brand enforcement, and anti-counterfeiting in China. Experience working with international brands and coordinating cross-border enforcement is highly desirable. Fluency in both written and spoken English. Deep knowledge of Chinese IP law and global brand protection strategies. Excellent interpersonal and communication skills to build relationships with internal and external partners.
